This Affiliates Policy (the “Policy” or “Agreement”) governs your participation in the Sobkichu Affiliate Program (the “Program”) operated by Sobkichu (sobkichu.site, “we”, “us”, or “our”). By applying to join the Program, accessing your affiliate dashboard, generating referral links, or otherwise participating, you (“Affiliate”, “you”, or “your”) agree to be legally bound by these terms and conditions.
This Agreement forms part of our overall Terms of Use and is incorporated by reference. If you do not agree to any part of this Policy, you must not participate in the Program. We reserve the right to update this Policy at any time – changes will be posted here with a revised date, and continued participation constitutes acceptance.
1. Program Overview and Eligibility
1.1 The Sobkichu Affiliate Program allows approved individuals or entities to earn commissions by promoting our curated products through unique referral links and driving qualifying sales on sobkichu.site.
1.2 Eligibility: To join, you must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering binding contracts. We may approve or reject applications at our sole discretion (e.g., based on your audience, promotion channels, or compliance history). We do not accept affiliates promoting illegal, adult, gambling, or misleading content.
1.3 No cost to join: The Program is free. There are no signup fees, monthly charges, or hidden costs.
2. Affiliate Responsibilities and Obligations
2.1 Promotion: You may promote Sobkichu products only through ethical, lawful methods. You agree to:
- Use only approved referral links and materials provided in your dashboard.
- Disclose your affiliate relationship clearly (e.g., “#ad”, “affiliate link”, or “I earn commission from purchases”) in compliance with Bangladesh advertising laws and consumer protection guidelines.
- Promote accurate product information without false claims, exaggerated benefits, or misleading pricing.
- Not engage in spam, unsolicited emails, bulk messaging, or deceptive practices.
2.2 Prohibited Activities: You must NOT:
- Bid on “Sobkichu”, “sobkichu.site”, or similar brand keywords in PPC/search ads (Google Ads, Facebook Ads, etc.).
- Use our brand name in domain names, social handles, or trademarks without permission.
- Self-refer (use your own links to make purchases or encourage friends/family for personal gain).
- Promote on websites/apps with illegal, pornographic, hate-related, violent, discriminatory, or misleading content.
- Offer unauthorized discounts, coupons, or cashback not provided by us.
- Engage in cookie stuffing, link hijacking, or any manipulation of tracking.
- Violate any laws, including consumer rights, data protection (PDPO 2025), or e-commerce regulations in Bangladesh.
Violation may result in immediate termination, commission forfeiture, and legal action.
3. Referral Links and Tracking
3.1 Upon approval, you get access to an affiliate dashboard where you can generate:
- Default store-wide referral links (for homepage or general promotion).
- Product-specific referral links (for individual items).
3.2 Tracking: We use cookies and unique referral IDs to attribute sales. The referral cookie remains active for **90 days** from the user’s first click on your link. If the user purchases within this period (even on a later visit), you earn commission (last-click attribution model).
3.3 No commission on: Self-referrals, returned/canceled orders, fraudulent transactions, or sales not properly tracked (e.g., due to ad blockers or manual cookie deletion).
4. Commission Structure and Payouts
4.1 Commission Rate: Flat **10%** on the net sale value (product price after discounts/returns, excluding shipping, COD fees, taxes, or other charges) for all products sold through your qualifying referrals.
4.2 Calculation: Commissions are based on confirmed, non-returned sales. Returns/refunds/cancellations deduct from your earnings.
4.3 Payout Schedule: Commissions are paid weekly once your balance reaches the minimum payout threshold of **৳500**. Balances below this carry over.
4.4 Payment Methods: bKash, Nagad, Rocket, or direct bank transfer (you provide details in your dashboard). You are responsible for any transaction fees or taxes on commissions.
4.5 No commission on your own purchases or referred sales that violate these terms.
5. Termination and Suspension
5.1 We may terminate or suspend your participation immediately (with or without notice) for violations, suspected fraud, low performance, or at our sole discretion.
5.2 Upon termination: Pending commissions may be forfeited if due to breach. You must stop using our links/materials immediately. You remain liable for any damages caused.
5.3 You may terminate anytime by notifying us – pending commissions will be paid if eligible.
6. Intellectual Property and Brand Usage
6.1 Limited License: We grant you a revocable, non-exclusive license to use our approved banners, text links, product images, and promotional materials solely for Program participation.
6.2 Restrictions: You may not alter, modify, or misuse our trademarks, logos, or content. Unauthorized use may lead to termination and legal claims.
7. Data Privacy and Compliance
7.1 Your use of the Program is subject to our Privacy Policy. You must handle any personal data (e.g., from your audience) in compliance with PDPO 2025 and not share it with us unless necessary.
7.2 You agree not to collect or misuse data from our site or users.
8. Limitation of Liability and Indemnification
8.1 We are not liable for indirect, consequential, or punitive damages arising from the Program. Our total liability is limited to commissions paid in the prior 6 months.
8.2 You indemnify us against claims arising from your promotion activities, violations, or misuse of materials.
9. Governing Law and Dispute Resolution
9.1 This Agreement is governed by the laws of Bangladesh. Disputes are subject to the exclusive jurisdiction of courts in Dhaka.
9.2 Attempt informal resolution first via info@sobkichu.site before legal action.
10. Miscellaneous
10.1 Entire Agreement: This Policy + our Terms of Use constitute the full agreement.
10.2 Severability: Invalid provisions do not affect the rest.
10.3 No Waiver: Failure to enforce does not waive rights.
10.4 Assignment: We may assign this Agreement; you may not without our consent.
